Analytical Study Maps Constitutional and Logistical Impacts of the Conflict on Elections in Ukraine

A new analytical study examines the legal, logistical, and social foundations conditioning the holding of elections and referendums in Ukraine during a state of war. The analysis is structured around three central axes that explain the operational and legal unfeasibility of electoral processes in the current scenario.

The document reinforces that any popular consultation or national election fundamentally depends on the termination of martial law and the restoration of minimum security conditions across the territory.

Highlights of the Survey:

Legal and Constitutional Scope: Article 19 of the Law on the Legal Regime of Martial Law explicitly prohibits presidential, parliamentary, and local elections, as well as referendums. In line with this, Article 108 of the Constitution determines that the President maintains institutional functions until an elected successor takes office. Any call for elections strictly requires the formal revocation of martial law by Parliament (Verkhovna Rada).

Logistical and Security Challenges: Millions of refugees abroad and internally displaced persons make organizing an inclusive vote unfeasible. Furthermore, the presence of hundreds of thousands of active-duty citizens in combat and the constant risk of air strikes prevent the security of voters and poll workers, compounded by high budgetary costs in an economy focused on defense.

Public Opinion and Political Consensus: Surveys by the Kyiv International Institute of Sociology (KIIS) and memorandums signed by the main parties with parliamentary seats show internal cohesion: the national priority is the defense of sovereignty, and new elections should occur only after the end of martial law and the attainment of security guarantees.
